These Terms and Conditions ("Terms") govern the purchase and use of tickets for RoadTrip Music Festival ("the Festival"), operated by the Downtown Kingston Business Improvement Area (BIA) ("we," "us," or "the Organiser"). By purchasing a ticket, you ("the Ticket Holder") acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.

1. Ticket Purchase

Tickets are sold exclusively through ‘Showpass’ our authorized ticketing partner, or through the Kingston Marriott. The Organizer is not responsible for tickets purchased through unofficial channels; such tickets may be invalid and will not entitle the holder to admission or a refund.

- All prices are in Canadian dollars (CAD) and inclusive of applicable taxes.

- A non-refundable service and processing fee applies to each transaction.

- Ticket quantities per customer may be limited.

- The Organizer reserves the right to cancel any order it reasonably suspects to be fraudulent or in violation of these Terms.

2. Ticket Validity and Transfers

Each ticket is valid only for the date(s) and admission tier specified at the time of purchase. Tickets are non-transferrable. Tickets resold above face value through unofficial channels may be cancelled without refund.

3. Refund Policy

All ticket sales are final. Refunds are not available except under the circumstances set out below.

3.1 Eligible Refund Circumstances

Refunds will be issued only in the following situations:

- The festival is cancelled by the Organizer with no rescheduled date announced.

- A duplicate ticket purchase is made in error and reported within 24 hours of the transaction.

- A ticket purchased through an authorized channel is found to be invalid through no fault of the Ticket Holder.

3.2 Refund Request Deadlines

Event Cancellation: Refunds will be provided within 30 days of the official cancellation announcement.

Duplicate Purchase: Requests must be submitted within 24 hours of the duplicate transaction.

3.4 Service and Processing Fees

Original service and processing fees are non-refundable unless the festival is cancelled by the Organiser.

3.5 Postponement

If the Festival is postponed, all tickets remain valid for the rescheduled date. Ticket Holders unable to attend the new date may request a refund within 21 days of the postponement announcement.

3.6 Exclusions

Refunds will not be issued for personal circumstances including illness, travel disruption, scheduling conflicts, or dissatisfaction with the lineup. We recommend purchasing third-party event cancellation insurance if you are concerned about unforeseen circumstances.

3.3 How to Request a Refund

To submit a refund request, email roadtrip@downtownkingston.ca with your full name, order confirmation number, and reason for the request. Allow up to 10 business days for review. Approved refunds will be returned to the original method of payment within 5–10 business days.

4. Admission and Entry

Ticket Holders must check-in by presenting a valid ticket (digital or printed) upon entry. The Organizer reserves the right to refuse admission or remove any individual who cannot produce a valid ticket, is intoxicated or in possession of prohibited substances, behaves in a disorderly or threatening manner, or violates any Festival Rule or applicable law. No refund will be issued in such cases.

5. Age Restrictions

RoadTrip Music Festival is an all-ages event unless otherwise stated. Licensed bar and lounge areas are restricted to individuals 19 years of age or older in accordance with Ontario liquor legislation. Valid government-issued photo identification may be required.

6. Prohibited Items

The following items are prohibited on Festival grounds: illegal drugs or controlled substances; outside alcohol; weapons of any kind; professional recording equipment (without media credentials); drones; outside food and beverages (medical or dietary exceptions require prior written approval); and any item deemed a safety risk by Festival security. Confiscated items will not be returned.

7. Photography and Recording

Personal photography and video using mobile phones or compact cameras is permitted for non-commercial use only. By attending the festival, you consent to being filmed or photographed by the Organizer and its partners, and grant the Organizer a royalty-free, perpetual licence to use such recordings for promotional purposes.

8. Health, Safety, and Assumption of Risk

Attendance at an outdoor live music festival involves inherent risks including crowd movement, adverse weather, and loud noise exposure. By purchasing a ticket, you voluntarily assume all such risks. You agree to comply with all health and safety protocols in effect at the time of the event, including any requirements imposed by provincial or federal public health authorities.

9. Limitation of Liability

To the fullest extent permitted by applicable law, the Organizer, its officers, employees, contractors, and agents shall not be liable for any direct, indirect, incidental, or consequential loss arising from your attendance, including personal injury, property loss, or disappointment due to lineup changes, shortened performances, or technical difficulties. In the event of cancellation, the Organizer's liability is limited to the face value of the ticket.

10. Force Majeure

The Organizer shall not be liable for failure to perform its obligations where such failure results from circumstances beyond its reasonable control, including acts of God, severe weather, pandemic, governmental order, civil unrest, or acts of terrorism. In such cases, the Organizer may cancel, postpone, or modify the Festival without additional liability.

11. Privacy

Personal information collected during ticket purchase is handled in accordance with our Privacy Policy and applicable Canadian privacy legislation, including PIPEDA. Your information will be used to process your order and communicate Festival updates. We do not sell personal information to third parties.

12. Accessibility

RoadTrip Music Festival is committed to providing an accessible experience. Accessible viewing areas, parking, and facilities are available on site. To arrange accommodations in advance, contact us at roadtrip@downtownkingston.ca.

13. Governing Law

These Terms are governed by the laws of the Province of Ontario and applicable Canadian federal law. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ontario.

14. Amendments

The Organizer reserves the right to amend these Terms at any time. Changes will be posted at www.roadtripkingston.ca and take effect immediately upon publication. Continued use of your ticket constitutes acceptance of the revised Terms.
